Italian antitrust authority launches investigation into Meta’s WhatsApp AI chatbot

The Italian antitrust watchdog, Autorità Garante della Concorrenza e del Mercato (AGCM), has launched an investigation into Meta, claiming the tech giant is effectively denying WhatsApp users access to its artificial intelligence (AI) tools. AGCM accused Meta, which retains a dominant position in the app-based communication services market, to place “dominant” users into the AI market through uninstalling its AI tools, thereby violating competition laws under the European Union.

The investigation highlights Meta’s provision of AI features to WhatsApp users, which could益励 its users to integrate these services into their Wi-Fi,andering home devices. Meta, having acquired WhatsApp, intended to leverage its dominant position in the WhatsApp ecosystem to promote its AI services. However, AGCM argues that this move undermines fair competition by deterring users from using free, domestically developed AI chatbots available on their own devices.

The antitrust authority noted that Meta’s integration of AI into WhatsApp may displace competitors by “expertise” that is not seen in WhatsApp itself. Ag.Round emphasized that while meta’s AI models and ecosystem have been installed in other regions of Europe, including Davis and Ireland, they are not yet banned there. Meanwhile, gradual deprecation and derails in WhatsApp data usage are expected from March 2025, raising questions of data privacy and anti-conpetitiveness.

The technology giant also questioned earlier EU-based regulations regarding its AI integration with WhatsApp early on, amid a delay due to “regulatory uncertainty.” Despite these challenges, the European Commission launched an inquiry into whether Meta’s AI integration falls under the scope of the Digital Services Act (DSA), a 2021 EU regulation aimed at protecting digital services and platforms from unfair monopolism.

The antitrust investigation by AGCM is slowing progress in challenging Meta’s substantial and widespread sophistication in the WhatsApp ecosystem. The case is facing significant opposition from WhatsApp users, who are concerned about being restricted from taking full advantage of the AI tools available on their devices.
