Social media fine print may restrict users’ right to sue, analysis shows

Of the countless rituals that define our digital lives, few are as universally practiced—and as universally ignored—as the act of scrolling past the “Terms and Conditions.” With a swift click of “I Agree,” we gain entry to the social networks, apps, and AI tools that connect and empower us. Yet, buried in those dense blocks of legal text are sweeping permissions that fundamentally shape our rights and privacy. A groundbreaking new research tool from Harvard University, called the Transparency Hub, is now pulling back the curtain on these critical documents. By archiving over 20,000 past and present legal agreements from more than 300 platforms, including giants like TikTok and Instagram, the project reveals a landscape where user autonomy is often quietly surrendered in the name of access. According to Professor Jonathan Zittrain, the platform’s goal is straightforward but profound: to finally make it possible for people to understand where their data travels and what legal protections they have actually retained—or waived.

One of the most alarming trends the Hub has quantified is the sheer inaccessibility of these contracts. Using a standard readability metric, researchers analyzed privacy policies from 2016 to 2025 and found that about 86 percent now require a college-level reading ability to comprehend. This means the rules governing our personal information are written in a language legible only to a minority, effectively excluding the average user from understanding the very agreements they are bound by. This growing complexity is not a neutral act; it functions as a barrier, ensuring that informed consent remains a theoretical ideal rather than a practical reality. The timing of this revelation is particularly significant, as European nations like France, Portugal, Spain, and Denmark are actively debating how to regulate social media and protect younger users from harm. If the guardians of these platforms—the terms and conditions—are themselves incomprehensible, how can any user, let alone a child or teenager, be expected to navigate the risks?

Beyond obscurity, the Transparency Hub uncovers a more active strategy employed by platforms to shield themselves from accountability: the systematic steering of disputes away from the public justice system. Researcher Kevin Wrenn, using the Hub’s data, highlights that users are increasingly forced into mandatory arbitration. This is a private, out-of-court process where a neutral third party, often chosen by the company itself, delivers a binding decision. The consequences are profound. Arbitration clauses quietly erase a user’s right to sue in a public court, moving conflict resolution into a confidential forum that lacks the transparency, precedent, and procedural protections of the judicial system. For the individual, this often means facing a corporation with vastly greater resources in a setting designed for efficiency, not equity.

This trend is notably advancing into the frontier of artificial intelligence. Current terms for leading AI platforms like Anthropic and Perplexity explicitly prohibit users from participating in class-action lawsuits. This forces anyone who suffers harm—whether from privacy violations, misinformation, or other damages—to pursue legal action alone, an intimidating and costly prospect that overwhelmingly favors the company. There is a glimmer of recourse in some policies; Perplexity’s terms, for instance, allow users to opt out of these restrictions by sending a written notice within 30 days of first use. However, this burden of proactive refusal falls entirely on the user, who must first locate, read, and act upon a clause hidden in a lengthy document they likely never properly read in the first place.

The research inevitably raises pressing questions about jurisdiction and fairness. It remains unclear whether European users, operating under the robust data protection framework of the GDPR, are subject to the exact same arbitration and class-action waiver clauses as users in the United States. This legal ambiguity underscores a broader tension: digital platforms operate globally, but the fine print of their contracts may create uneven landscapes of justice. When reached for comment on their policies by Euronews Next, neither Anthropic nor Perplexity provided an immediate response, leaving users in the dark about the rationale behind these restrictive terms.

Ultimately, the Harvard Transparency Hub does more than archive legal documents; it illuminates a pervasive power imbalance in the digital age. The combination of deliberately complex language and contractual clauses that limit collective legal action creates a perfect storm where user rights are diluted. These “terms and conditions” are not mere formalities—they are the constitutive rules of our online societies. By making their evolution and implications visible, the Hub provides an essential tool for regulators, advocates, and, hopefully, a better-informed public to demand clarity and fairness. The goal is not to eliminate these agreements but to transform them from instruments of obfuscation and control into legible covenants of trust, ensuring that the digital world is governed by principles that are understandable and just for everyone who inhabits it.
